Abstract: Though the precautionary principle has been enshrined in the Treaty on the Functioning of the EU since 1993 and in a number of directives, regulations, as well as national framework legislations in the course of the 1990s, it is still dogged by controversies. Critics belittle the role the principle could play in the EU decision-making process. However, in several landmark cases, the Court of Justice of the EU has nullified EU regulations running counter the principle. In other cases, the Court has condemned national practices departing from precaution. Professor de Sadeleer shall shed the light on recent EU case law developments.
